GOOD GOVERNOR BAD NOMINEE

The headline will surprise many as very supportive of the Republican Governor and her policies. First of all this is a non partisan site and neither Democrats, Republicans or any one else gets a pass when it comes to reporting facts or analyzing politics or policy. Some of our contributors like to say that we hate and love them all equally. This is why analysis is written anonymously and news feeds are credited where possible. Bit we digress from the topic, this nominee that would make a Klansman blush.

The Connecticut State Legislature's judiciary committee postponed action on the nomination of Judge John R. Downey to the Sates Appellate Court. Problems arose when it was learned that Downey had praised former segregationist Senator Strom Thurmond and also by misleading lawmakers about statement s he had made in 2002 regarding the rights of immigrants to use the courts. The committee obtained a copy of two transcripts in which the judge, , emphatically stated that illegal immigrants have no right to the state's civil courts. Legislators say he ignored case law and the state constitution.

This view whether popular or unpopular is not legally correct and to allow a judge to legislate immigration policy from he bench of the appeals court would be a disaster for justice. The nomination of Judge Downey also raises several other issues. One being that if he is rejected ( which he should be) how can he possible serve in the capacity as a superior court judge in the future? Second to this is how will this botched nomination impact Governor Rell in Hispanic and Black communities which typically vote Democratic but have embraced her after the John Rowland resigned.

It is no secret that Governor Rell has transcended race by her solid performance since taking over as Governor. Further proof of this is her thumping of John Destefano in last years election. We urge Governor Rell to withdraw this nomination.
